GENERAL TERMS AND CONDITIONS OF SALES

 

These general terms and conditions of sales (hereinafter the “general and condition of sale”) govern without restriction the sales of products (hereinafter “products”) made between Leony (Trademark owned by Pietro Bazzani and the customers on the website www.leony.eu 

 

ARTICLE 1. PURPOSE

These general terms and conditions of sales govern the rights and obligations of the parties resulting from the sale of products offered on the website leony.eu the products purchased via the website www.leony.eu  are sold through the Leony (Trademark owned by Pietro Bazzani) which offers them to customers.

 

ARTICLE 2. CONTRACT PARTIES

SELLER: Pietro Bazzani Via Rivetta, 21 - 15033 Casale Monferrato, AL -  Italy
CUSTOMER: Non-trader individuals who operate for purposes which exclude any professional or commercial activity.

 

ARTICLE 3. ACCEPTANCE OF THE TERMS AND CONDITIONS

Any order of a product offered on the website implies the customer’s full acceptance of these general terms and conditions of sales, they constitute, with the validation and confirmation of the order, the contract concluded between Leony and the customer. Leony reserves the right, in its sole discretion, to change the terms under which the website is offered. It is the responsibility of the customer to periodically check the website for any changes to these terms to ensure familiarity with the most recent version. The general terms and conditions of sale applicable are those in force on the website on the date the order is placed. Any order of a product offered on the website implies the customer’s full acceptance of these general terms and conditions of sales. They constitute, with the validation and confirmation of the order and contract concluded between Leony and the customer.

 

ARTICLE 4. DOCUMENTS

The customer may purchase any product presented as available and at the price indicated on the website on the day he places his order. The order confirmation is recorded in the registers of Pietro Bazzani, the customer accepts that the order confirmation is considered proof of the contract concluded with Leony on its website. Placing an order constitutes the customer acceptance of the prices and characteristic of the products purchased on the website, as well as these therms and conditions. Our acceptance of your order brings into existence a legally binding contract between us. The customer is entirely responsible to read and keep a copy of these conditions of sales.

 

ARTICLE 5. REGISTRATION ON THE WEBSITE AND CUSTOMER PERSONAL DATA

In order to place an order on Leony website, each customer should create an account by following the registration procedure and by providing the necessary information. On the creation of account, the customer chooses a login and a password which will be specific to themselves for identification on the website. The customer is solely responsible for keeping these elements confidential. Customer personal data will be protected in compliance with Italian legislative decree No. 196 of 30 June 2003, Italian personal data protection code, called “right to the protection of personal data”. Pietro Bazzani guarantees that the processing of personal data will be carried out in compliance with the fundamental rights mentioned above, with specific attention to privacy, personal identity and the right to personal data protection. All details communicated by the interested parties are utilized exclusively to fulfill commercial activities, such as the supply and sales of products and related services, like carry out market research. Only after their authorization, customer personal data may be used for the purpose of mailing advertising or direct marketing material. Use of customer personal data for the purpose of mailing advertising or marketing related business is optional and decided by the customer at the time of registration.
It is the exclusive responsibility of the customer: That all personal data provided as required by the website is accurate. Keep user ID and password confidential. Seller is not responsible for wrong use of passwords.

 

ARTICLE 6. PRICES AND PRODUCTS

All products are made with hypoallergenic material based on the provisions on legislative decree No. 206 of 6/9/2005. All Leony Jewelry is made of 925/1000 sterling silver. The products prices are indicated on the website in euros. The seller reserves the right to modify prices. The customer has to pay the full price agreed at payment time. European Union prices include value added tax and delivery costs (free shipping for orders over € 150,00).

Outside European Union all the customs procedures and any possible adding costs (E.G. Package stopped by customs) remain at the exclusive charge of the seller. Promotions, promo codes, coupons are valid if confirmed by the seller in order confirmation (see article 9). Leony has made every effort to display as accurately as possible the colors of the products that appear on the website www.leony.eu. However, as computer monitors may vary, we cannot guarantee that the color of the products will be completely accurate.

 

ARTICLE 7. DELIVERY OF THE ORDER

After placing the order, customers should choose payment method and indicate billing and shipping address. For orders placed outside Italy from Italians, fiscal code is required. For orders placed outside Italy from non – Italians date and place of birth is required. Customers must be of legal age and have the legal capacity to conclude such a contract, otherwise it will not be valid.

 

ARTICLE 8. PAYMENT METHODS

Please note that occasional pricing and errors may occur on the website. Leony reserves the right to revise pricing, products and errors. Leony reserves the right to cancel any order placed if there was errors concerning the price or availability of any item  at the time of order. If your credit card has already been charged for the purchase and your order is cancelled, Leony will issue a credit to your credit card for the amount charged.

The seller accepts only the payment methods indicated on the website. Other methods can be accepted only with prior consent of the seller (for further information send an email to info@leony.eu). In case of payment with credit card or Paypal, transactions are made via a secure platform accessible from Pietro Bazzani only. All credit card details are completely secure.

If you purchase any products on the website, you will need to provide certain information relating to your purchase, including without limitation your credit or debit card number, the expiration date of your credit card, your billing address, and your shipping information. You confirm and warrant that you have the legal right to use any credit/debit card(s) utilized in connection with any transaction. You also grant us or the third vendor collecting that information on our behalf the right to provide such information to third parties for processing the transactions initiated by you or on your behalf.

We may also need to conduct certain verification of information prior to processing any transaction. Risk of loss or damage of all products is only transferred to the customer upon shipment from Leony. It is the customers responsibility to comply with all applicable local, state, federal, and foreign laws in regards to the possession, use and sale of any item purchased from the website. By placing an order, you represent that the products ordered will be used only in a lawful manner.

 

ARTICLE 9. CONFIRMATION OF THE ORDER

Following the payment, a confirmation email summarizing the details of the order is sent to the customer, to the email address indicated in the contact details. If no later than 24 hours following acceptance of the payment, the customer doesn’t inform the seller about changes or modifications, the details and data provided will be accepted and the order is registered and considered definitive. In the event of the unavailability of a product, the seller will inform the customer as soon as possible within 30 days after validation of the order and payment. In the above mentioned case, the seller will cancel the entire order and refund its amount to the customer, including taxes and delivery costs. Otherwise, prior authorization of the customer, the seller could deliver a product of an equivalent quality and price. Pietro Bazzani reserves the right not to validate the order on legitimate grounds and in particular in the event of:

  • Abnormal or abusive claims from the customer during previous orders;

  • Abnormal or abusive exchange and returns from the customer during previous orders;

  • Existing dispute(s) with the customer, no goods in stock for any reason.

The seller will prepare the order in the next days from Monday to Friday from 11 am to 4 pm – Italian time.

 

ARTICLE 10. DELIVERY OF THE ORDER

Shipping is free for orders over Euro 150,00. While we attempt to ship all orders as soon as possible, most orders received after 2 pm will likely go out the following business day. We do ask that you allow up to 3 business days for orders to be fulfilled. We ask that you allow up to 3 business days for orders to be fulfilled. Leony has chosen to partner with GLS / DHL for shipment.

Products are delivered to the address indicated by the customer at time of order on the website www.leony.eu. The delivery slip handed over by the carrier will constitute proof of transport and delivery.

In case of delay, damage, total or partial losses of products and/or of the order, it is the responsibility of the customer to exercise any remedy directly with the carrier and inform Leony at the same time. Leony will make its best effort to ensure that the orders will be delivered in a period of time between 2 and 10 business days as of receipt of the customer’s payment. In any event, all products purchased will be delivered within a maximum period of 15 business days from the day following receipt of payment.

Customized products will be delivered within 20 business days and in any event within 30 business days as of the day following receipt of payment.

Transport costs remains at the seller’s charge.

Leony may not be held responsible for delays in delivery due to errors attributable to carriers. Leony may not remedy any defaults in execution of carrier which it does not want to assume, but may possibly help the customer with the carrier. Our products are not available for the following countries: Iran, Russia, Ukraine, Sudan, North Corea, Syria.

ARTICLE 11. RECEPTION OF THE ORDER

The customer must verify the content and the condition of the products. The customer must check the condition of the products delivered before signing the acknowledgement of receipt of the package. If the customer finds any anomalies, must refuse the delivery of the products. After 24 hours, claims are not accepted and the products will be considered checked and verified by the customer.


Leony jewelry is mainly handmade or hand-finished, for this reason every product is a unique piece; little differences between what is received and pictures shown on the website will not be considered as defects.

 

ARTICLE 12. ACKNOWLEDGEMENT OF RECEIPT

After the payment of the order the seller will prepare a receipt of payment. In order to prepare receipt of payment and invoice Italian customers must indicate their fiscal code, Non Italians customers must indicate their date and place of birth.

 

ARTICLE 13. RIGHT OF WITHDRAWAL AND RETURNS

The customers are free to exercise return right by written communication sent to info@leony.eu and sending back the product within 14 business days from reception of the order. The customers should download the goods return form from the website and put in the package. Returns will be accepted only in their original packaging, with any labels and accessories, in perfect condition for resale. They must not have been used or damaged. if above conditions are fulfilled, Emanuele Bicocchi will refund the amount within 30 business days.

Customers have a legal obligation to take reasonable care of the items while they are in their possession. If customers fail to comply with this obligation, entitlement to a refund may be affected. Customers must also attach the return slip and receipt. In the event of a breach of the conditions set forth here above, Leony may refuse the returns and not proceed with the refund; returned damaged products with not receipt will not be refunded. In this case,

if the customer requests a reshipment of the products ordered, Leony reserves the right to request the customer to pay the costs for reshipping.

The return costs will be borne exclusively by the customer. If accepted, the refund will be made within 30 business days as of receipt of the products.

 

To receive full refund of the item(s) :

  • The products must be in its original condition and in their original packaging;

  • The products must be not altered or modified;

  • All products can be returned within business 14 days;

  • Products may not be returned after 14 business days.

Please note that also for exchanges, products will still need to be in unused, unworn, unaltered and undamaged condition. All returns must include original packaging: any boxes, dust bags, labels or other packaging materials.

 

We offer a tolerant return policy in order to provide customers with a happy shopping experience.
Frequent returns made from the same account will automatically be flagged in our system. If we notice that our return policy is being abused, we may take action in the form of blocking an account or cancelling orders. We reserve the right to reject returns which do not comply with our Return Policy.

 

ARTICLE 14. EXCEPTIONS

The right of withdrawal will not be accepted for products that has been customized for the customers. If customers finds any lack of conformity or a hidden defect in the products must immediately inform the seller. Customized size products cannot be refund.

 

ARTICLE 15. WARRANTY, COMPLIANCE AND REPLACEMENT OF PRODUCTS

The seller take every care to ensure that description and specifications of the products are correct at the time of purchase and delivery. Customers benefits from the legal compliance warranties from the date of delivery (show on the transport document). Leony jewelry is protected under warranty for a period of 18 months from the original purchase date. Please note that any evidence or tempering will void the warranty. If customers find any lack of conformity or a hidden defect in the products ordered, they must inform the seller by email at info@leony.eu. After expiration of the warranty, for repairs we will charge our customer an adequate amount.

 

ARTICLE 16. OWNERSHIP OF RIGHTS

Pietro Bazzani Via Rivetta, 21, Casale Monferrato, AL - Italy is the sole holder of the Leony trademark along with all the figurative elements present on the website, the partial or total reproduction of the Leony trademark is prohibited. The resale of the products purchase on www.leony.eu is strictly prohibited. Customers cannot modify, distribute or re-sell anything on this website for any purpose. If it happens, or if the seller thinks it happened, he reserves the right to not sell anything anymore to that customer.
